1. What This Warranty Covers

HeartHero, Inc. (“HeartHero”) warrants to the original purchaser that the HeartHero AED Elliot automated external defibrillator (the “Device”) will be free from defects in materials and workmanship under normal use for the warranty periods below:

  • Device (main unit): Six years from the date of manufacture
  • Electrode pads: Until the expiration date printed on the packaging
  • Carrying case and non-consumable accessories: 12 months from the date of original purchase

This warranty applies only when the Device is (a) used in accordance with HeartHero’s instructions, labeling, and user manual; and (b) maintained in accordance with HeartHero’s recommended inspection and maintenance schedule.

2. What This Warranty Does Not Cover

This warranty does not cover:

  • Batteries, which are consumable items with a separate shelf life;
  • Normal wear and tear, including cosmetic damage that does not affect functionality;
  • Damage caused by misuse, abuse, neglect, accident, or improper storage;
  • Failure resulting from use outside the Device’s published environmental or operational specifications;
  • Damage caused by fire, flood, power surge, or other external causes;
  • Devices that have been opened, modified, serviced, or repaired by anyone not authorized by HeartHero; or
  • Software issues caused by unauthorized modifications.

3. How to Make a Warranty Claim

If you believe your Device has a defect covered by this warranty:

  • Contact HeartHero or your local authorized distributor with a description of the issue. Customers in Australia, New Zealand, and Fiji may contact Elliot Australia, the authorized distributor, at support@elliotaed.com.au or 1300 854 951. Customers outside this region may contact HeartHero directly at support@hearthero.com or +1 720.577.4606.
  • HeartHero will assess whether the claim is covered. If so, HeartHero will issue a Return Goods Authorization (“RGA”) number.
  • Ship the Device to HeartHero using the RGA number provided. HeartHero will cover the cost of return shipping for valid warranty claims.

Please do not return any Device without first obtaining an RGA number.

4. What HeartHero Will Do

If HeartHero determines that a Device is defective due to materials or workmanship during the warranty period, HeartHero will, at its sole discretion:

  • Repair the Device; or
  • Replace the Device or the defective component with a new or refurbished unit of equal or greater functionality; or
  • If the original model is no longer available, provide a functionally equivalent replacement.

This is your exclusive remedy under this warranty, subject to your statutory rights described in Section 6 below.

5. Limitation of Liability

To the maximum extent permitted by applicable law:

  • HeartHero’s total liability under this warranty will not exceed the original purchase price paid for the Device.
  • HeartHero is not liable for any indirect, incidental, special, or consequential damages arising from the use or inability to use the Device.
  • Except as expressly stated in this warranty, and to the fullest extent permitted by law, HeartHero disclaims all other warranties, whether express or implied, including any implied warranties of merchantability or fitness for a particular purpose.

Nothing in this warranty excludes, restricts, or modifies any rights or remedies you may have under applicable law that cannot be excluded or limited, including the consumer guarantees under the Australian Consumer Law and the New Zealand Consumer Guarantees Act 1993.

6. Your Statutory Rights

This warranty is in addition to, and does not replace, your rights under applicable consumer protection laws.

For Australian consumers:

Our goods come with guarantees that cannot be excluded under the Australian Consumer Law. You are entitled to a replacement or refund for a major failure and compensation for any other reasonably foreseeable loss or damage. You are also entitled to have the goods repaired or replaced if the goods fail to be of acceptable quality and the failure does not amount to a major failure.

For New Zealand consumers:

This warranty is in addition to your rights under the Consumer Guarantees Act 1993, which provides guarantees that cannot be excluded for goods acquired for personal or domestic use.

7. Your Responsibilities

To maintain warranty coverage, you should:

  • Perform regular device checks and maintenance as described in the user manual
  • Register the Device at hearthero.com/register within 30 days of purchase
  • Promptly notify HeartHero if you suspect a defect

Failure to register the Device will not void this warranty, but registration helps HeartHero contact you about important safety notices and product updates.

8. Transferability

This warranty may be transferred to a subsequent owner of the Device, provided the Device was originally purchased from HeartHero or an authorized HeartHero distributor. The warranty period is not extended or renewed upon transfer.

9. Governing Law

This warranty is governed by the laws of the jurisdiction where the Device was purchased. Where the Device is purchased in Australia, Australian law (including the Australian Consumer Law) applies. Where the Device is purchased in New Zealand, New Zealand law (including the Consumer Guarantees Act 1993) applies. For all other jurisdictions, this warranty is governed by the laws of the State of Colorado, USA.
